Terms of Service

The following terms of service (these "Terms of Service") govern your access to and use of my5mm.com and the 5 Minute Mindfulness products offered through it (together, being the "Site"), including any content, functionality, and services offered on or through the Site ("Services") and any other media form, channel, mobile site, or mobile application related, linked, or otherwise connected to the Site provided by White Elephant Enterprises, Inc., a South Carolina S corporation ("White Elephant," "we," "us," or "our"). "You," or "user" means you as a user of the Site.

Please read the Terms of Service carefully before you start using the Site. By using the Site or placing an order, you accept and agree to be bound and abide by these Terms of Service. You further acknowledge you have read and understood our Privacy Policy. If you do not want to agree to these Terms of Service or the Privacy Policy, you must not access or use the Site.

This Site is offered and available to users who are at least 18 years of age and of legal age to form a binding contract. By using the Site, you represent and warrant that you meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Site.

1. About 5 Minute Mindfulness

5 Minute Mindfulness ("5MM") is a set of printed activity cards created by Robyn Hussa Farrell. Each card pairs original mixed-media artwork with a brief mindfulness practice.

The cards are wellness and educational materials. They are not medical devices, medical advice, psychological treatment, or a substitute for care from a licensed professional. Nothing on the Site or on the cards is intended to diagnose, treat, cure, or prevent any condition, and no statement on the Site creates a provider-patient or therapeutic relationship. If you are experiencing a mental health crisis or have concerns about your health, contact a qualified healthcare provider. In an emergency, call 911 or the 988 Suicide and Crisis Lifeline.

2. Intellectual Property Rights

Unless otherwise indicated, the Site is the property of White Elephant and all source code, databases, functionality, software, Site designs, audio, video, text, photographs, card artwork, printed practices, interactive features, and graphics of any nature and regardless of format (herein, collectively, or individually, the "Materials") and the trademarks, service marks, and logos used in connection with the Site (the "Marks") are owned and controlled by White Elephant and Robyn Hussa Farrell and are protected by copyright and trademark laws and any other applicable intellectual property law or regulation of the United States, foreign jurisdictions, and international conventions. The Materials and Marks are provided "As-Is." Except as expressly provided herein, no part of the Site and no Materials may be copied, reproduced, aggregated, republished, uploaded, posted, displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without White Elephant's express prior written permission. White Elephant reserves all rights in the Site, Materials, and Marks.

Purchasing cards gives you the right to use them personally. It does not transfer any ownership or license in the artwork or the printed practices. You may not reproduce, scan, photograph for redistribution, republish, resell, or create derivative works from the cards without our prior written permission.

Educators, clinicians, and organizations interested in using 5MM in a professional, classroom, or group setting should contact us at the address in Section 17 to discuss licensing.

3. Products and Descriptions

We try to display our products accurately. The card artwork is reproduced from original mixed-media pieces, and colors, textures, and finishes may vary slightly between what you see on your screen and the printed cards you receive. Screen calibration differs from device to device. Minor variation of this kind is a characteristic of the product and is not a defect.

We reserve the right to modify, discontinue, or limit the availability of any product at any time without notice.

4. Orders and Order Acceptance

Placing an order through the Site is an offer to purchase, not a completed sale. We may accept or decline any order for any lawful reason, including product availability, suspected fraud, or an error in pricing or product information. A contract of sale is formed only when we ship the order to you.

If we decline or cancel an order after you have been charged, we will refund the full amount charged.

We may limit or cancel quantities purchased per person, per household, or per order.

Any attempt to defraud White Elephant through deceptive tactics such as using different names, emails, IP addresses, or payment methods will result in immediate cancellation of the order and may result in a permanent bar from purchasing.

5. Pricing and Errors

All prices are stated in U.S. dollars and are subject to change without notice. Shipping is calculated at checkout and shown before you complete your purchase.

Despite our efforts, a product on the Site may occasionally be listed at an incorrect price or with incorrect information. If a product's correct price is higher than the price shown, we may either contact you for instructions before shipping or cancel the order and notify you. We are not obligated to honor an order placed at an incorrect price.

6. Payment

Payments are processed by Stripe, Inc. By placing an order you agree to Stripe's terms and authorize us to charge your selected payment method for the total shown at checkout, including shipping.

We do not receive or store your full payment card details. Card information is transmitted directly to Stripe. See our Privacy Policy for detail on what information we do receive.

Your card statement will show a charge from WHITE ELEPHANT.

7. Shipping and Delivery

We currently ship to addresses in the United States only. We do not ship internationally.

Orders are packed and shipped typically within 3 to 5 business days of purchase. Delivery times after shipment depend on the carrier and are not guaranteed. We are not responsible for carrier delays.

You are responsible for providing a complete and accurate shipping address. We are not responsible for orders delivered to an address you entered incorrectly, and re-shipment in that situation is at your expense.

Risk of loss and title pass to you when we deliver the order to the carrier. If a package arrives damaged, contact us at the address in Section 17 within 14 days of delivery and we will work with you to resolve it.

8. Returns and Refunds

You may return unopened, unused cards within 30 days of delivery for a refund of the purchase price.

The following conditions apply:

  1. Returns must be initiated within 30 days of the delivery date by contacting us at the address in Section 17.
  2. Cards must be unopened and in resalable condition. Opened or used card sets are not eligible for return.
  3. You are responsible for return shipping costs. We recommend a trackable method, as we cannot issue a refund for a return we do not receive.
  4. Original shipping charges are not refunded.
  5. Refunds are issued to the original payment method within 10 business days of our receipt and inspection of the returned items.

Damaged or incorrect orders. If your order arrives damaged or we sent the wrong item, contact us within 14 days of delivery. We will replace the item or issue a full refund, including shipping, at no cost to you. Do not return damaged items until you have heard from us.

This policy is in addition to, and does not limit, any rights you may have under applicable law.

9. Sales Tax

You are responsible for any sales, use, or similar taxes that apply to your purchase. Where we are required to collect tax, it will be shown at checkout. Where we are not required to collect, you may still owe use tax to your state, and you are responsible for reporting and paying it.

10. User Representations and Restrictions

You may access and use the Site as made available to you, as long as you comply with these Terms of Service and applicable law. You represent and warrant that all information you supply, including your shipping address and payment information, is accurate and that you are authorized to use the payment method you provide.

The following restrictions apply to your use of the Site. You are not allowed to:

  1. Make any unauthorized use of the Site;
  2. Circumvent, disable, or otherwise interfere with security-related features on the Site;
  3. Trick, defraud, or mislead White Elephant or other users;
  4. Interfere with, disrupt, or create an undue burden on the Site or White Elephant's networks or servers;
  5. Use the Site in an effort to compete with White Elephant;
  6. Decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Site;
  7. Bypass any measures on the Site designed to prevent or restrict access to the Site or any portion thereof;
  8. Harass, annoy, intimidate, or threaten any of White Elephant's employees, independent contractors, or agents;
  9. Use any automated system to access the Site in a manner that sends more request messages than a human could reasonably produce in the same period;
  10. Resell products purchased from the Site without our written permission.

11. Privacy Policy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms of Service by reference. By using the Site, you consent to the collection and use of information as described in the Privacy Policy.

12. Age Restrictions

White Elephant does not knowingly solicit data from or market to anyone under the age of 18. By use of the Site, you represent that you are at least 18 years of age. Purchases must be made by adults. All personal information of a user under the age of 18 collected without proper parental consent will be promptly deleted upon White Elephant's discovery of that user's minor status.

13. Modification and Interruption

We reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at our sole discretion without notice. We cannot guarantee the Site will be available at all times. We may experience hardware, software, or other problems, or need to perform maintenance, resulting in interruptions, delays, or errors. You agree that White Elephant has no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Site during any downtime or discontinuance.

14. Disclaimer

The Site and all products are provided on an as-is, as-available basis. You agree that your use of the Site and Services is at your sole risk. White Elephant disclaims all warranties, express or implied, in connection with the Site and your use thereof, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. White Elephant makes no warranties or representations about the accuracy or completeness of the Site or any content thereon or content of any sites linked to the Site, and White Elephant assumes no liability for any errors, mistakes, or inaccuracies of content and materials, personal injury, or property damage, of any nature whatsoever, any unauthorized access to or use of our servers and/or any personal information and/or financial information stored therein, any interruption or cessation of transmission to or from the Site, any bugs, viruses, Trojan horses, or the like which may be transmitted to or through the Site by any third party, and/or any errors or omissions in content and materials or for any loss or damage of any kind incurred as a result of the use of any content posted, transmitted, or otherwise made available through the Site. White Elephant does not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party either through the Site, a hyperlinked site, or any site or mobile application featured in any advertising.

Nothing in this section limits any warranty or right that cannot be excluded or limited under applicable law.

15. Limitations of Liability and Indemnification

IN NO EVENT WILL WHITE ELEPHANT, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SITE OR SUCH OTHER WEBSITES, OR ANY PRODUCTS, SERVICES, OR ITEMS OBTAINED THROUGH THE SITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

NOTHING IN THESE TERMS OF SERVICE EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU. IN ANY JURISDICTION WHERE THE FOREGOING EXCLUSION IS NOT PERMITTED IN FULL, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OF SERVICE OR ANY PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

You agree to indemnify, hold harmless, and pay the defense costs of White Elephant and its subsidiaries, affiliates and all respective officers, members, agents, partners, employees and independent contractors from and against any loss, damage, liability, claim, or demand including reasonable attorneys' fees and expenses, made by any third party due to or arising out of: (1) use or misuse of the Site or products purchased through it; (2) breach of these Terms of Service; (3) any breach of your representations and warranties set forth herein; and (4) your violation of the rights of any third party, including but not limited to intellectual property rights.

16. Electronic Communications, Transactions, and Signatures

You hereby consent to receive electronic communications from White Elephant and you agree that all agreements, notices, disclosures, and other communications sent via email or through the Site satisfy any legal requirement that such communication be in writing. You hereby agree to the use of electronic signatures, contracts, orders, and other records, and to electronic delivery of notices, policies, and records of transactions initiated or completed by White Elephant or through the Site. You hereby waive any rights or requirements under any statutes, regulations, rules, ordinances, or other laws in any jurisdiction which require an original signature or delivery or retention of non-electronic records or to payments or the granting of credits by any means other than electronic.

18. Third-Party Links

The Site may contain links to third-party websites, including sharpenminds.com. Such links are provided for your convenience. White Elephant has no control over the contents of those sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them. Your use of a third-party site is governed by that site's own terms and privacy policy.

19. Jurisdiction

The Site is hosted in the United States of America, and we ship only within the United States. Access to the Site from the EU, Asia, or another region of the world may result in the applicability of laws, statutes, or regulations differing from those of the United States which govern personal data collection, use, or disclosure. Your continued use of the Site and transfer of data to the United States constitutes express consent by you to the transfer and processing of data in the United States.

20. Governing Law

These Terms of Service will be governed by and construed in accordance with the laws of the State of California without regard to conflict of law principles.

21. Litigation

Any legal action of whatever nature will be brought in the state or federal courts in the State of California. The parties hereto consent to personal jurisdiction in said courts and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to venue and jurisdiction.

If you are a consumer residing outside California, this provision does not deprive you of the protection of any mandatory provision of the law of your place of residence.

22. Termination

We reserve the right, in our sole discretion and without notice or liability, to deny access to and use of the Site to any person for any reason, including breach of any representation, warranty, or covenant contained in these Terms of Service or of any applicable law or regulation.

23. Miscellaneous

These Terms of Service and any policies posted on the Site or regarding the Site constitute the entire agreement and understanding between you and White Elephant. Failure of White Elephant to enforce any right or provision of these Terms of Service will not operate as a waiver of such right or provision. If any provision or part of these Terms of Service is determined to be unlawful, void, or unenforceable, that provision will be severed from these Terms of Service but will not otherwise affect the validity or unenforceability of the remaining provisions herein. Nothing in these Terms of Service, the Privacy Policy, or on the Site will be construed to constitute the forming of a joint venture, partnership, employment, or agency relationship between you and White Elephant.

24. Modification of These Terms

We may revise these Terms of Service at any time. Any revisions will be indicated by an accompanying revision date and will take effect as soon as the revision is published on the Site. Changes do not apply retroactively to orders already placed. You are encouraged to review these Terms of Service frequently for updates. Your continued use of the Site after changes are posted means you accept the revised Terms of Service.
