Privacy Policy

White Elephant Enterprises, Inc. ("White Elephant") takes your privacy very seriously. This Privacy Policy explains how we collect, use, disclose, and protect information that applies to my5mm.com and the 5 Minute Mindfulness products offered through it (together, being the "Site"), any related services, sales, marketing, or events (collectively referred to herein as "Services"), and your choices about the collection and use of your information.

White Elephant Enterprises, Inc. is a South Carolina S corporation.

Capitalized terms that are not defined in this Privacy Policy have the meaning given to them in our Terms of Service. If you do not want your information processed in accordance with this Privacy Policy in general or any part of it, you should not use our Services and should discontinue use of the Site immediately. If you have any questions or concerns about this Privacy Policy or White Elephant's practices with regard to your information, please contact us at the address in Section 12.

1. Information We Collect

We sell printed cards. We collect what we need to take your order and ship it.

Information you provide when you place an order. When you check out, you provide your name, email address, shipping address, and payment details. Payment details are handled as described in Section 2.

We do not have user accounts. You cannot create a profile or store a password on the Site, so we do not hold login credentials.

Information you provide when you contact us. If you email us with a question, a return request, or a report of a damaged order, we receive whatever information you choose to include.

Information collected automatically. Our hosting provider records standard server request information, including IP address, browser type, and pages requested. This is used to operate and secure the Site.

2. Payment Information

Payments are processed by Stripe, Inc. When you enter your card details at checkout, that information passes directly from your browser to Stripe.

We never receive or store your full card number, security code, or expiration date. What we receive from Stripe is limited to your name, email address, shipping address, the items and amounts purchased, the last four digits of the card, and the card brand.

Stripe processes your information under its own privacy policy, available at stripe.com/privacy.

3. How We Use Your Information

We use the information we collect to:

1. Process and fulfill your order;
2. Send you an order receipt and, where applicable, shipping and refund notices;
3. Respond to questions, return requests, and reports of damaged or incorrect orders;
4. Handle refunds and payment disputes;
5. Keep records required for tax and accounting purposes;
6. Detect and prevent fraud and maintain the security of the Site.

We do not send marketing email from the Site, and we do not add you to a mailing list because you placed an order.

4. Your Information and Sharing with Third Party Services

We share information only with service providers who help us operate the Site and fulfill orders, and only to the extent needed for them to perform that function:

White Elephant does not sell your personal information, and does not share it for cross-context behavioral advertising.

We may also disclose information where required by law, in response to valid legal process, or where we believe in good faith that disclosure is necessary to protect our rights, your safety or the safety of others, or to investigate fraud. If our business or its assets are sold or transferred, customer information may transfer as part of that transaction.

5. Cookies and Tracking Technology

The Site uses only the cookies necessary for it to function and for your cart to work during your visit.

We do not run advertising trackers or third-party analytics on the Site, and we do not use cookies for advertising or cross-site tracking.

Do Not Track. Browsers may send a Do Not Track signal. There is no common industry standard for responding to these signals, and we do not track users across sites in any case.

6. Keeping Your Information Safe

White Elephant cares about the security of your information and uses appropriate safeguards to preserve the integrity and security of all information collected through use of the Services, including encrypted connections to the Site and to our service providers, and access controls limiting who can view order data. However, White Elephant cannot ensure or warrant the security of any information you transmit to White Elephant or guarantee that information may not be accessed, disclosed, altered, or destroyed.

7. Your Choices About Your Information

Because we do not maintain accounts or send marketing email, there is no subscription to manage or profile to edit. To ask a question about your information, request a copy of it, request a correction, or request deletion, contact us at the address in Section 12. See Section 9 for the specific rights that may apply to you.

8. How Long White Elephant Keeps Your Information

We retain order records for as long as we have a valid purpose to do so, including fulfilling the order, handling returns and payment disputes, and complying with our legal, tax, and audit obligations. This is generally seven years. We retain correspondence for as long as needed to address your question and a reasonable period afterward.

Upon White Elephant's determination that it has no further legitimate business need for your personal information, White Elephant will delete or anonymize that information or securely store it and isolate it from any further processing until deletion is facilitated.

9. Your Privacy Rights

Depending on where you live, you may have the right to:

1. Know what personal information we hold about you;
2. Access a copy of that information;
3. Correct inaccurate information;
4. Delete your information, subject to records we are required to retain for legal, tax, and accounting reasons;
5. Opt out of the sale or sharing of your personal information. We do not sell or share personal information, so there is nothing to opt out of.

To exercise any of these rights, email tfarrell@whiteelephantenterprises.com. We will respond within the time required by applicable law, generally 45 days. We may need to verify your identity before acting on a request, which will usually mean confirming details of an order you placed.

White Elephant will not discriminate against you for exercising any of these rights.

California residents. The California Consumer Privacy Act, as amended by the California Privacy Rights Act, provides California residents the rights described above. In the 12 months preceding the date of this Privacy Policy, we collected the categories of information described in Section 1, for the purposes described in Section 3, and disclosed them to the service providers listed in Section 4. We did not sell or share personal information.

10. White Elephant Does Not Collect Information from Minors

White Elephant does not knowingly solicit data from or market to anyone under the age of 18. Purchases must be made by adults. By use of the Services, you represent that you are at least 18 years of age. All personal information of a user under the age of 18 collected without proper parental consent will be promptly deleted upon White Elephant's discovery of that user's minor status.

11. Links to Other Websites and Services

The Site contains links to sharpenminds.com and may link to other websites and services. White Elephant is not responsible for the privacy practices of websites it does not operate. We encourage you to review the privacy policy of any site before providing information to it.

13. Keeping You Updated on White Elephant's Privacy Policy

White Elephant reserves the right to update this Privacy Policy at any time and from time to time in White Elephant's sole determination. Any revisions will be indicated as such by an accompanying revision date and will take effect as soon as the revision is published on the Site. White Elephant, in its sole discretion and upon a material change to this Privacy Policy, may notify you either by prominent posting of such change on the Site or by directly sending notification to you. You are encouraged to review this Privacy Policy frequently for updates.
